Welcome to TalkAI Premium! As you review our Terms of Service, we ask that you take the time to read and understand the following pages carefully.

These Terms of Service ("Terms", "Terms of Service") apply to your use of our website located at https://premium.talkai.info/ operated by Talkai.info. Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information resulting from your use of our web pages. Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). By accessing or using our Service, you acknowledge that you have read and understood these Agreements and agree to be bound by them.

If you do not agree with (or cannot comply with) these Agreements, please do not use the Service. However, please let us know by emailing info@talkai.info so we can try to find a solution.

These Terms apply to all visitors, users, and others who wish to access or use our Service.

1. Access to Services

You must be at least 13 years old to use TalkAI Services and over the age of 18 to create an account at TalkAI Premium. If you are under 18 you must have your parent or legal guardian’s permission to use the Services. If you use the Services on behalf of another person or entity, you must have the authority to accept the Terms on their behalf.

2. Usage Requirements

a) Use of Services. You may access, and we grant you a non-exclusive right to use, the Services in accordance with these Terms. You will comply with these Terms and all applicable laws when using the Services.

b) Feedback. We appreciate feedback, comments, ideas, proposals and suggestions for improvements. If you provide any of these things, we may use it without restriction or compensation to you. You can contact us via our contact form or by email at info@talkai.info.

c) Restrictions. You may not:

  • use the Services in a way that infringes, misappropriates or violates any person’s rights;
  • reverse assemble, reverse compile, decompile, translate or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the Services (except to the extent such restrictions are contrary to applicable law);
  • represent that output from the Services was human-generated when it is not or otherwise violate our Usage Policies;
  • send us any personal information of children under 13 or the applicable age of digital consent;
  • use automated methods to access the Service.

If any of these rules are violated, the administration has the right to block access to the Service without refund.

d) Third Party Services. Any third-party software, services, or other products you use in connection with the Services are subject to their own terms, and we are not responsible for third party products.

3. Content

a) Your Content. You may provide input to the Services (“Input”), and receive output generated and returned by the Services based on the Input (“Output”). Input and Output are collectively “Content.” As between the parties and to the extent permitted by applicable law, you own all Input. Subject to your compliance with these Terms, TalkAI hereby assigns to you all its right, title and interest in and to Output. This means you can use Content for any purpose, including commercial purposes such as sale or publication, if you comply with these Terms. TalkAI may use Content to provide and maintain the Services, comply with applicable law, and enforce our policies. You are responsible for Content, including for ensuring that it does not violate any applicable law or these Terms.

b) Similarity of Content. Due to the nature of machine learning, Output may not be unique across users and the Services may generate the same or similar output for OpenAI or a third party. For example, you may provide input to a model such as “What color is the sky?” and receive output such as “The sky is blue.” Other users may also ask similar questions and receive the same response. Responses that are requested by and generated for other users are not considered your Content.

c) Accuracy. Artificial intelligence and machine learning are rapidly evolving fields of study. Given the probabilistic nature of machine learning, use of our Services may in some situations result in incorrect Output that does not accurately reflect real people, places, or facts. You should evaluate the accuracy of any Output as appropriate for your use case, including by using human review of the Output.

d) Responsibility. We use OpenAI's public API to run our service. All chatbot responses that you receive as a result of the service are generated on the servers of OpenAI company and they are responsible for them.

4. Purchases

If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to modify the number of words charged for the output or input or impose any usage restrictions per hour, regardless of what was previously committed at the time of subscription. These changes will be made according to our model capacity to safeguard the interests of all users and to ensure uniform access to the service. We take this step to provide equal opportunity to every user and protect the quality of our service.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

5. Subscriptions

TalkAI Premium offers Service on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"), either monthly or annually depending on the type of subscription plan you select when purchasing a Subscription. At the end of each Billing Cycle, your Subscription will automatically renew unless you cancel it or TalkAI Premium cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting TalkAI Premium's customer support team.

To process the payment for your Subscription, a valid payment method such as a credit card or PayPal is required. You must provide TalkAI Premium with accurate and complete billing information, including your full name, address, state, zip code, telephone number, and valid payment method information. By submitting such payment information, you authorize TalkAI Premium to charge all Subscription fees incurred through your account to any payment instruments you provide. If automatic billing fails to occur for any reason, TalkAI Premium will issue an electronic invoice indicating that you must manually pay the full amount corresponding to the billing period as indicated on the invoice.

6. Fees and Payments

a) Fees and Billing. You will pay all fees charged to your account (“Fees”) according to the prices and terms on the applicable pricing page, or as otherwise agreed between us in writing. We have the right to correct pricing errors or mistakes even if we have already issued an invoice or received payment. You will provide complete and accurate billing information including a valid and authorized payment method. We will charge your payment method on an agreed-upon periodic basis, but may reasonably change the date on which the charge is posted. You authorize TalkAI and its affiliates, and our third-party payment processor(s), to charge your payment method for the Fees. If your payment cannot be completed, we will provide you written notice and may suspend access to the Services until payment is received. 

b) Taxes. Unless otherwise stated, Fees do not include federal, state, local, and foreign taxes, duties, and other similar assessments. You are responsible for all Taxes associated with your purchase.

c) Price Changes. We may change our prices by posting notice to your account and/or to our website. Price increases will be effective 14 days after they are posted. Any price changes will apply to the Fees charged to your account immediately after the effective date of the changes.

7. Refunds

We issue refunds for Contracts within seven (7) days of the original purchase of the Contract with the condition that your words usage is less than 15000 words and fewer than 15 images should be generated. Refunds are NOT issued automatically. If you decide to cancel your account, please remember to contact us within three days of the cancellation to request a refund. Please note that refunds are applicable only to the current subscription charge on your account. We're unable to provide refunds for charges from the prior month or for additional charges added to your account.

If you meet these conditions and would like a refund, here's what you need to do:

  • First, please cancel your account.
  • Next, send an email to support@talkai.info to initiate the refund process.

We are committed to addressing your requests in a timely manner. We will respond to your request within 24-48 hours. Please note that your refund request will be timestamped and honored based on when you send your email.

8. Accounts

When you create an account with TalkAI Premium, you guarantee that you are over the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on our Service.

You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or a name that is not lawfully available for use or offensive, vulgar, or obscene. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

Furthermore, you acknowledge that your account is for your personal use only and may not be shared with others. Sharing or allowing unauthorized access to your account is strictly prohibited and may result in the suspension or termination of your account.

9. Intellectual Property

TalkAI Premium and its licensors own and retain all rights, title, and interest in and to the Service and its original content (excluding content provided by users), features, and functionality. The Service is protected by copyright, trademark, and other laws of United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TalkAI.

10. Copyright Policy

We respect the intellectual property rights of others and have a policy to respond to any claim that Content posted on our Service infringes on the copyright or other intellectual property rights of any person or entity. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a claim to our Copyright Agent via email at support@talkai.info.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through our Service on your copyright.

11. DMCA Notice and Procedure for Copyright Infringement Claims

To submit a notification pursuant to the Digital Millennium Copyright Act (DMCA), please provide our Copyright Agent with the following information in writing:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest;
  • A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
  • Identification of the URL or other specific location on our Service where the material that you claim is infringing is located;
  • Your address, telephone number, and email address;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

12. Indemnification; Disclaimer of Warranties; Limitations on Liability

a) Indemnity. You will defend, indemnify, and hold harmless us, our affiliates, and our personnel, from and against any claims, losses, and expenses (including attorneys’ fees) arising from or relating to your use of the Services, including your Content, products or services you develop or offer in connection with the Services, and your breach of these Terms or violation of applicable law.

b) Disclaimer. THE SERVICES ARE PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES AND LICENSORS MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE SERVICES, AND DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE OR ERROR FREE, OR THAT ANY CONTENT WILL BE SECURE OR NOT LOST OR ALTERED.

c) Limitations of Liability. NEITHER WE NOR ANY OF OUR AFFILIATES OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ​​THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE OR ONE HUNDRED DOLLARS ($100). THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

13. General Terms

a) Relationship of the Parties. These Terms do not create a partnership, joint venture or agency relationship between you and TalkAI or any of TalkAI’s affiliates. TalkAI and you are independent contractors and neither party will have the power to bind the other or to incur obligations on the other’s behalf without the other party’s prior written consent.

b) Use of Brands. You may not use TalkAI’s or any of its affiliates’ names, logos, or trademarks, without our prior written consent.

c) Copyright complaints. If you believe that your intellectual property rights have been violated, please notify us via email at info@talkai.info.

d) Modifications. We may amend these Terms from time to time by posting a revised version on the website, or if an update materially adversely affects your rights or obligations under these Terms we will provide notice to you either by emailing the email associated with your account or providing an in-product notification. Your continued use of the Services after any change means you agree to such change.

14. Confirmation

By using the Service or any other services provided by TalkAI, the user acknowledges that they have read and agree to be bound by these Terms of Service.
